Legal practitioner, researcher, and author Daniel Korang has urged the public to remain calm and law-abiding during arrests, advising that the appropriate response is to ask for the reason behind the arrest rather than resort to violence.
“You don’t start using violence against the arresting officer,” Mr Korang stated.
“What you do is this: ask, ‘Can you please tell me why you are arresting me?”
According to Mr Korang, individuals have every right to demand an explanation for their arrest, and this right may be exercised repeatedly.
“You can insist on this as many times as you can – you are demanding to know why you are being arrested,” he said.
Speaking on JoyNews’ The Law on Sunday, April 13, he further emphasised that the arresting officer is legally bound to provide the reason for the arrest.
Failing to do so, he warned, constitutes a breach of the law.
“If the arresting officer fails to explain the reason for the arrest, then the officer has already violated the law,” he explained.
Such a failure, Mr Korang noted, amounts to a violation of the suspect’s fundamental human rights, as guaranteed under Ghanaian law.
In such instances, he added, the affected individual may have legal grounds to pursue action against the officer.
"The law relating to arrest, and that violation is a violation of a suspect's fundamental human right for which the suspect can even sue him later," he concluded.
