Justice of the High Courts of Ghana and The Gambia, Alexander Osei Tutu says a surviving spouse or child cannot be ejected from the matrimonial home.
According to him, ejecting a surviving spouse is contrary to the law [Section 17 of PNDC law].
Speaking on JoyNews’ The Law, he noted that the same applies in a case where the surviving spouse or child is in a rented property.
According to him, ejection can only be made when it is pursuant to court action.
“You cannot eject the spouse or the child where the matrimonial home is a rented property...Even if the house is not the property of the deceased and you are the landlord, you cannot eject them.”
He, however, stated that in cases where the matrimonial home is a family home, ejection can occur after six months.
