The Supreme Court has indefinitely adjourned an appeal hearing for which National Chairman of the National Democratic Congress (NDC) is facing trial.
Samuel Ofosu-Ampofo is accused by the state of conspiracy to assault public officials, evidence gained from a leaked tape of a meeting of NDC functionaries.
But opposition stalwart has pleaded not guilty, insisting the tape has been doctored to suit the motive of his accusers.
During the trial, the High Court, admitted into evidence a written testimony of Nana Osei Ampofo Agyei, a journalist who is a witness in the case.
However, Mr. Agyei denied authoring the statement and also disclosed he has no knowledge of its content.
He only signed the document, the journalist told the court.
The court admitted the statement, arguing since the witness admitted to signing it, it is admissible.
Mr. Ofosu-Ampofo and his lawyers who disagreed with this, sought interpretation from the Supreme Court.
However, as the case was called, the applicants, Ofosu-Ampofo and his lawyers were not in court.
“We are informed by the Registrar that for some strange reasons, the applicant and his lawyers have not been served with hearing notice for today’s sitting.
“We direct that appropriate measure should be instituted against the bailiff’s inability to serve the applicant with the hearing,” presiding judge, Jones Dotse is quoted to have said.
The case was then adjourned indefinitely.
