Dear Ghana Police,
Let’s be even clearer.
- First or initiating court processes, what we call originating processes, are not served on lawyers, unless a lawyer writes to the court to expressly request to accept them for and behalf of a client. Basic Civil Procedure 101.
- You cannot arrest, detained or restrict a person unless they are suspected of an offence. In the circumstances, as earlier explained where you are rather in the wrong and abusing the rights of the demonstrators, what offence(s) will you charge them with?
- Dear law-abiding citizen, if for face-saving purposes, you are arraigned on trumped-up charges and you win, you can sue for malicious prosecution.
- One of the lawyers attending to those arrested tells Joynews their phones have been seized. Phones or such devices liable to seizure only if they are evidence of a suspected crime, and even so they can only be accessed upon a court order.
- Fight the unconstitutional new direction where the police seem to be requiring all demonstrations to terminate at the Black Star Square. Insist on your rights always.
