The Appeal Court in Accra on Monday dismissed a notice of appeal filed by the National Association of Graduate Teachers (NAGRAT) against the ruling of an Accra High Court asking the Association to comply with an order of the National Labour Commission (NLC) to call off a strike it embarked upon last year.
A statement signed by Mohammed Affum, Public Relations Officer of the NLC, said in dismissing the appeal, the Court indicated that available records showed that NAGRAT did not file any statement of case and therefore demonstrated their unwillingness to prosecute the appeal.
The statement said the Court did not award any costs.
It said in its grounds of appeal filed on November 7, 2006, NAGRAT said the ruling of the High Court was against the weight of evidence before it as well as arguments canvassed by the NLC.
NAGRAT prayed the Court to set aside the ruling.
However, the NLC in its motion urged the Court to dismiss NAGRAT's notice of appeal because the Association had failed to comply with conditions of appeal and therefore had demonstrated their unwillingness to prosecute the appeal.
The Accra Fast Track High Court on October 31 last year ordered NAGRAT to call of its strike because it was illegal.
