Member of Parliament for Bolga East, Dr. Dominic Akuritinga Ayine says the high court’s judgement on the NCA’s $4million scandal cannot be supported by evidence.

Speaking on Joy News’ Newsfile Saturday, Dr. Ayine who is the Chairman of Parliament’s Subsidiary Legislation Committee said no injury whatsoever had been caused to the state.

He explained that, “The judgment cannot be supported by the evidence, look at it this way; if you’re talking about the offense of causing financial loss to the state…it must have been the quality drain case where [Justice] Modibo Ocran made it clear that it must be a situation in which the conduct of the public officer in question has injured the state financially.”

A former Director General of the National Communications Authority (NCA), William Tetteh Tevie, the former Board Chairman of the Authority, Eugene Baffoe-Bonnie and a former National Security representative coordinator, Salifu Osman have been handed jail terms for their role in causing $4 million financial loss to the state.

Among the charges were stealing, using public office for personal gains, and willfully causing financial loss to the state with respect to the purchase of a Pegasus machine worth $4 million, to among other things assist in the fight against terrorism.

According to the Bolga East MP, the transaction for which the former NCA boss and others had been jailed for was carried out according to a signed agreement and there was no evidence of wrongdoing.

“What injury has been caused to the Republic of Ghana in this transaction? You see, there is a transaction, there is local company that is representing an Israeli company. And it is through that local company that monies are transferred to the Israeli company.

“And so there was no agreement that the Israeli company be paid directly the 4million dollars so it must have been the local company receiving it as agent of the Pegasus and then giving those monies to the Israeli company.

“So the point is this when monies are being paid to an agent it is deemed that the principal has received the money.”
