An injunction has been filed at an Accra Fast-Track High Court to restrain the Chief Scout Commissioner and his Deputy from holding themselves in office.
The motion was filed by Commissioners Abdul Hamid and Abdul Aziz and Skipper Jerry Aikins, members of the Greater Accra Regional Scout Council.
The three are also seeking an order to restrain the two and Commissioner Noble Louis Parcoo from representing the Association in National and international events until the final determination of the case.
In their statement of claim filed at the court, the three Greater Accra Regional Scout Council members accused the Chief Scout Commissioner, the Deputy Chief Scout Commissioner and Commissioner Parcoo of having inaugurated a new constitution for the Association taking retrospective effect.
The motion also stated that the three intend to organise an annual general meeting in June under the purported new constitution.
The three members of the Greater Accra Regional Scout Council said the purported constitution was illegal as it was not voted for.
They pointed out further that the procedure for adopting the constitution was also not in agreement with the existing constitution and therefore unconstitutional.
According to the applicants, the three respondents had an interest in changing the constitution to the detriment of members of the Ghana Scout Association (GSA) and urged the court to restrain them from going ahead with their plans.
They noted that Commissioners Addy, Nartey and Parcoo were already applying the purported constitution and that even though the term of office of the first two had ended, they were still holding themselves as officials.
The applicants called on the court to restrain the respondents before they caused "Untold hardship and irreparable loss" to the Association.
They stated that the Chief Scout Commissioner and the Deputy were appointed and given terms of employment by law, which was the constitution of the association and should operate within the same laws.
"It would be just and convenient to restrain the respondents if they are not prepared to operate within the same constitution under which they were elected and especially when they have used unorthodox means to adopt their own constitution against all legal principles," the Greater Accra Regional Scout Council Members stated.
