Former Energy Minister, Boakye Agyarko has revealed that a representative of GPGC allegedly pleaded with him to remove their contract from the list of contracts to be terminated, even before the decision to abrogate was made public.

 A letter signed under his hand, communicating the termination of the contract has been questioned following the award of a 170 million judgment debt to GPGC.

But in an interview Asempa FM, Mr Agyarko said he acted on a cabinet decision based on technical advice.

Therefore he could not remove the GPGC contract from termination since the instruction is supposed to come from Cabinet.

“Even before the letter went, somebody from GPGC came to my office. A gentleman, he introduced himself as Manuel Soyah. He came pleading that the GPGC should be removed from termination, then I asked on what basis? He had a lot to say and I responded saying Mister who am I? Cabinet has given me instructions.

"If I am to vary the instructions, a similar instruction must come from Cabinet, that these people upon further consideration has been removed from it then I can oblige but you sitting here, saying this can work. It is not how bureaucracies work. It is not my decision, it’s the Cabinet decision so I cannot,” he said.

Boakye Agyarko also urged government to review its position on international arbitration, alleging bias against third world countries.

 “I was of the opinion when we were coming into government that we should take all these international arbitration clauses out of our contracts. The structure of arbitration has never favored any third world country.

“What is international arbitration? They don’t trust your legal system. They don’t trust your warranties and representations. If they don’t trust our legal system, let us improve our judicial system so that it can command the confidence and respect for all,” he advised.
