The lawyer for the former Secretary of the Inter-Ministerial Committee on illegal mining, Charles Bissue, has expressed shock over what he described as a ‘disregard of proper discretion’ in the manner in which the Special Prosecutor is after his client.
According to Nana Agyei Baffuor Awuah, although he has heard about the warrant of arrest for his client, he is yet to receive it.
He said he is still waiting while giving the OSP the benefit of the doubt.
This, in an interview on Joy FM’s Top Story on Thursday, Mr Baffuor Awuah explains is because “I don’t believe he [OSP] will do that. I don’t believe he would disregard proper discretion in the way and manner he is handling this matter.”
He, however, stated that he does not in any way doubt the publication of the arrest warrant for Charles Bissue as well.
His comment comes after the OSP secured a court order to arrest former Secretary of the Inter-Ministerial Committee on Illegal Mining (IMCIM), Charles Bissue.
The order was secured after Mr Bissue failed to honour an invitation by the Special Prosecutor last month.
Prior to the arrest warrant, Mr Bissue went to the High Court to stop the OSP from investigating him over suspected corruption and corruption-related offences involving a public officer.
According to Mr Bissue, an investigation cannot be launched when a copy of the petition forming the basis of the investigation has not been given to him.
In a writ sighted by JoyNews, Mr Bissue argued that the OSP in its half-year report dated December 31, 2022, had stated that “the Office has concluded an investigation into the allegation of the use of public office for profit against Charles Bissue during his tenure as secretary to the erstwhile Inter-Ministerial Committee on Illegal Mining (IMCIM) arising from an investigative documentary titled Galamsey Fraud Part 1 published by Tiger Eye P.I and the journalist, Anas Aremeyaw Anas.”
The lawyer questioned why the OSP is threading in ordinate haste to arrest Mr Bissue even though there are three pending suits against him.
“Where is he in a hurry to? Why can’t he allow the processes to run their course? Is it because he has got scores to settle?” he quizzed.
“It is a cat-and-mouse game as we speak. He cannot wait for the court processes to be completed. He has gone for an arrest warrant and so as a litigator, I also know what to do,” he added.
When asked whether his client was on the run over the arrest warrant, he replied in the negative.
According to him, Mr Bissue is not on the run, adding that he is a politician who intends to compete for a political office therefore he is on the ground working towards that.
Meanwhile, the legal practitioner has asserted that despite the court order for his client’s arrest he will not be turning himself in.
