The High Court in Accra presided over by Justice Forson Agyapong, has granted the application by the New Patriotic Party (NPP) that sought to compel the Electoral Commission (EC) to complete the collation of parliamentary results for the Okaikwei Central constituency in the Greater Accra Region.
Joy News’ Kwaku Asante reported from the court that, “In his third ruling, Justice Forson Agyapong has ruled in favour of the NPP, who had requested an order of mandamus to compel the EC to complete the collation of results in the constituency.”
In his judgement, Justice Forson Agyapong stated, “The EC did not complete the collation of results in the constituency, as there are 31 outstanding polling stations that have not been collated. The EC was required to act, but it has failed to do so.”
The judge has therefore ordered that “The EC completes the collation of results from the outstanding 31 polling stations and incorporates those into the already collated results.”
The court also instructed the Ghana Police Service to provide the necessary security to ensure a smooth re-collation exercise in the constituency. “The Inspector General of Police (IGP) should provide adequate and armed security to the EC to facilitate the completion of the collation and the declaration of a winner,” Kwaku Asante reported.
Justice Forson Agyapong had previously ruled in favour of the NPP in similar cases involving the Tema Central and Ablekuma North constituencies.
In those cases, he ordered the EC to collate the outstanding results for both constituencies. In Tema Central, the NDC's Ebi Bright had been declared MP-elect after the December 7 polls; however, the NPP raised concerns about poor collation, blaming it on NDC supporters who created chaotic scenes that disrupted the process.
Consequently, the NPP took the case to court, seeking a re-collation of the results, arguing that Ebi Bright was not the legitimate winner.
Similarly, in the Ablekuma North constituency, the NPP challenged the NDC’s candidate, who had initially been declared the winner, leading to further legal proceedings.
In Ablekuma North, the High Court ordered the collation of 62 polling station results before declaration.
