The opposition National Democratic Congress (NDC) says its future government will probe and prosecute government officials involved in the termination of the Ghana Power Generation Company (GPGC) contract.

National Communications Officer of the party, Sammy Gyamfi, described as "untrue and misleading" claims by Attorney General, Godfred Dame, that the termination of the emergency power agreement was occasioned by excess capacity charges.

According to him, a letter purportedly written and signed by the former Energy Minister, Boakye Agyarko, on reason assigned to the abrogation of the contract cited failure by GPGC to secure a license from the Energy Commission plus failure to secure a siting and construction permit for the project.

This, he believes is in sharp contrast with the position of the Attorney General.

The country is set to pay a $170 million judgment debt over the wrongful termination of a contract with an independent power producer, GPGC.

Speaking at a press conference, Sammy Gyamfi insists that the contract's termination is wrongful and without any lawful justification.

"The implementation of the GPGC EPA proceeded smoothly under the Mahama/NDC administration until the Akufo-Addo/Bawumia government took over the reins of power in the year 2017.

"On 13th February, 2018, the Minister for Energy, Boakye Agyarko wrote to terminate the GPGC EPA. The termination of the GPGC EPA,  according to Boakye Agyarko, was on the instructions of Cabinet, which is chaired by President Danquah Akufo-Addo.

Mr Gyamfi said, "It is instructive to note that the reasons which were cited by the Akufo-Addo government as the basis for the termination of the GPGC EPA did not include any issue of excess power or excess capacity charges as government would have us believe."
