The Public Relations Officer of the Ghana Bar Association (GBA), Saviour Kudze, says although the Dormaahene, Osagyefo Badu II has every right to make the comment he made about the ongoing Gyakye Quayson criminal trial, he chose the wrong forum to air his views.
Speaking at the 10th-anniversary lecture of John Evans Atta Mills, in Sunyani, Osagyefo Agyemang Badu who’s known in judicial practice as His Lordship, Justice Daniel Mensah, said pursuing the case will not contribute to the country’s development in anyway.
“As a matter of urgency, I am appealing to the President of the Republic, Attorney General if he has any role to play, that the trial should be aborted,” he appealed.
But the GBA PRO believes the forum was not appropriate.
“He [Dormaahene] has every right to make such a suggestion, but the forum was not right,” he said on Joy FM’s Top Story on Monday.
He said although the Dormaahene had the right to reach out to the Attorney General on the matter, he could have done that privately as a High Court judge.
He added that the Dormaahene could have also chosen to air his views through a write-up to benefit all since judges have a journal.

The revered traditional ruler called on the Attorney General, Godfred Yeboah Dame “to as a matter of urgency file a nolle prosequi to end that particular decision.”
Again, he expressed worry about the Supreme Court’s ruling which resulted in Mr Quayson being removed from parliament.
The Dormaahene made it clear that he would have taken a divergent stance if he had been part of the panel deciding on the matter.
The GBA PRO described the Dormaahene’s comment as worrying, saying only the Attorney General reserves the power and the discretion to file a nolle prosequi in a criminal matter.

Meanwhile, the Attorney General, Godfred Yeboah Dame, has also reacted to the comment.
According to him, this and many other comments by high-profile personalities have the propensity to affect the state of justice delivery and must be discouraged.
Mr Dame stressed that such remarks have the potential to jeopardise the fair adjudication of the case, adding that comments undermining the administration of justice should not be tolerated.

“I will come out with a proper statement on the matter and it will be in respect of all comments generally which have the tendency to subvert the administration of justice, I think that it is very unhealthy for our democratic dispensation and we must not countenance same.”
