Communications Officer of the National Democratic Congress (NDC), Sammy Gyamfi says Attorney-General (AG), Godfred Dame's failure to swear an affidavit to refute allegations by the third accused in the Ambulance case proves that the allegations are true.
While under cross-examination on May 23, Richard Jakpa, the third accused in the ambulance purchase trial, alleged that Attorney-General Godfred Yeboah Dame had previously approached him to help build a case against Minority Leader and former Deputy Finance Minister, Dr Cassiel Ato Forson, in the case.
Following the allegation levelled against the A-G, the court case was adjourned.
However, during proceedings on June 4, Mr Dame did not respond personally to the allegations but asked a principal state Attorney, Richard Gyambiby to take the affidavit on his behalf to respond to the matters.
According to Sammy Gyamfi, the Attorney-General's conduct goes to prove that the third accused allegation was right.
Speaking on Joy FM's Top Story, Sammy Gyamfi argues that the Attorney-General had every opportunity to respond to these claims if he wanted to but deliberately decided not to.
“These are damning assertions by a witness that bother not only on professional misconduct or prosecutorial misconduct on the part of the A-G but also on crime.
“What you will expect any prosecutor, any lawyer, any Attorney-General what he sought to do is to swear an Affidavits in opposition to these very damning assertions of the third accused.
“You will expect him to deny or to dispute these claims and demonstrate to the court that they are vexatious, scandalous and false but to our amazement, Godfred Dame yet again decided to flee from accountability,” he told host, Samuel Kojo Brace.
On the same show, private legal practitioner Martin Kpebu adds that although the law permits another to swear the affidavit, it would only weaken the A-G's case.
“Godfred Dame can say anybody should do it for him but what it does is that it weakens Godfred's case. That is what Sammy Gyamfi is saying is that Godfred should have confronted Jakpa through the affidavit in opposition but the fact that Godfred is running away further shows that yes, the contents of the tape are true that is the point,” he said.
