A group calling itself Concerned Youth in Subin, have registered its displeasure about the intention of Mr. Isaac Osei, former Ghana's Ambassador to the UK, to contest the parliamentary seat for the Subin constituency on the ticket of the New Patriotic party (NPP).
The group, led by Jerry Amponsah, has raised concerns about possible disqualification of former ambassador and currently the Chief Executive Officer of the Ghana Cocoa Board (COCOBOD) and has petitioned the National Executives of the party to immediately disqualify the aspirant.
The petition was copied to the Regional Executives of the party as well as Council of Elders of the party in Ashanti. Other signatories of the petition include Osei Kwabena, Abena Pokuaa, Matilda Addai and Joana Poku.
The main grounds of the petition are that the COCOBOD chief does not fultill the electoral requirements of the national Constitution of 1992, the party constitution, as well as the Guidelines and electoral rules and regulations of the NPP.
The petitioners referred to Article 94 of the 1992 Constitution which provides that a person shall not be qualitied to be a Member of Parliament unless “he is resident in the constituency for which he stands as candidate for election to parliament or has resided there for a total period of not less than five year out of the ten years immediately preceding the election for which he stands, or he hails from that constituency.”
They have also referred to Article 11(14), 11(15) and 18 of the party’s constitution to buttress their point of the envoy’s disqualification.
Article 11(4) provides that “No member shall be entitled to apply for nomination as the Party's Parliamentary candidate for any constituency unless he or she is a registered member and voter in the constituency, provided that in appropriate cases the Constituency Executive Commission may dispense with this requirement".
Article 11 (5) also provides that "It shall be the obligation of the member seeking nomination as the party's parliamentary member to satisfy the Constituency Executive Committee that the conditions stipulated in Article 11(4) have been fulfilled and any application which does not comply with these conditions shall be rejected.”
Similarly, Article 18 of the NPP Constitution provides that "there shall be separate rules and regulations of the party to supplement the provisions of the Constitution. The rules and regulations may provide the guidelines needed for the Constituency, Regional, Overseas and National organizations and operations of the party."
The group also referred to the rules and regulations and directives issued by the National Executive Council of the NPP on February 27, 2008.
While section 1 of the said guidelines provides that "An aspiring parliamentary candidate must ensure that he or she meets the requirements of qualification and eligibility set out in Alticle 94 of the Constitution of the Republic and Articles 3 and 11 among others of the party’s constitution" section 2 provides that "An aspiring candidate must have shown proof of demonstrable commitment to developing and nurturing the part) particularly at the level of the Constituency in which he/she see(s nomination for at least two year ."
On the strength of said provisions, spokesman Amponsah said, Isaac Osei, in the face of Article 94 of the 1992 Constitution is not resident in the Subin Constituency and that as a fact, he (Isaac Osei) has not been resident in the Subin Constituency for at least five years out of the ten immediately preceding the up-coming elections.
Amponsah also pointed out for a fact that Isaac Osei does not hail from the Subin Constituency neither is he a registered member and voter in the Subin Constituency contrary to constitutional requirements at the national and party levels.
