His Lordship Justice S.A.Brobbey, a Supreme Court judge has said, litigation in chieftaincy has become a national issue which needs urgent attention. He said “no region in Ghana is not plagued with one chieftaincy dispute or another, and we cannot go on like this forever.” The Supreme Court Judge mentioned Dagbon, Fomena, Oda, Akwamu Bawku, Accra, Sekondi, Wenchi, Adansi Akwamu, Anlo, as some of the trouble spots in the country. He maintained that chieftaincy litigation cannot entirely be eliminated but can be contained and reduced. Justice Brobbey made these remarks on the Citi FM Morning show on Monday, after he launched a book entitled “Law of Chieftaincy in Ghana.” Justice Brobbey outlined the procedures involved in becoming a chief, as well as post installation difficulties as some of the major causes of chieftaincy litigation. For one to become a chief, he has to be nominated, selected, elected, and enstooled/enskinned, but these processes in themselves are dogged with numerous infractions, Justice Brobbey noted. As to how a person becomes a Chief, the Supreme Court Judge, said one has to hail from the royal family with the right lineage. “It is not enough to say I am a member of the royal family and in the right lineage so make me a chief.” Justice Brobbey remarked. He said the chieftaincy institution is an expensive enterprise and needs somebody within the royal family with the right resources and the time to be made a chief. Justice S.A Brobbey was unequivocal on the idea of chiefs engaging in active partisan politics. He said chiefs who wanted to engage in active partisan politics should resign their positions as chiefs, citing Dr. Hilla Limann as a clear example. He noted the chief’s role is to unite and not divide his people, and supporting one party or another has the tendency of polarizing his own people. The book he said was purposely for Chiefs, but can always be of use to academics, students, and lawyers.
