A Cape Coast High Court has dismissed an application filed by Henry Tackie, Group Managing Director of Barony Construction Limited and Tacoa Construction Limited, seeking to commit the UCC Vice-Chancellor and two other senior officers of the university to contempt.
Professor Joseph Ghartey-Ampiah (Vice-Chancellor, UCC), Philip Ntim Owusu (Director of Physical Development and Estate Management, UCC) and Solomon Faakye (Head of Legal, UCC) for contempt of Court were accused of having flouted the orders of the court.
Mr Tackie filed the application for contempt through his Lawyer, Charles William Zwennes, of Gaisie Zwennes Hughes & Co. for contempt before the High Court, Cape Coast,
alleging that the three officers of UCC had seized property that had been built by the Mr Tackie’s construction firm whilst a matter concerning the property was pending before the Court.
The Court, presided by his Lordship Justice Emmanuel Lodoh, in addition, awarded a cost of ¢15,000.00 against the applicant, Mr Tackie.
The Judge, thus, acquitted and discharged the respondents, three senior officials of UCC, of the contempt charge for lack of evidence.
The two companies were awarded four separate contracts by the University of Cape Coast with a total contract sum of about ¢40 million in 2014 and 2015.
The University of Cape Coast alleges it discovered that the companies through their Managing Director, Mr Tackie, presented fake bank guarantees to secure the Contracts.
Consequently, the University Council rescinded the Contracts and brought an action against the two companies for recovery of the advance payment and fraudulent misrepresentation.
The substantive case would be decided by the court on April, 20, 2020.
