The Office of the Special Prosecutor (OSP) says it has written to the International Criminal Police Organisation (INTERPOL) to withdraw the Red Notice issued for Samuel Adam Foster aka Samuel Adam Mahama in connection with his role in the Airbus bribery scandal.

A Red Notice is a request to law enforcement worldwide to locate and provisionally arrest a person pending extradition, surrender, or similar legal action.

According to INTERPOL, Mr Adam Mahama, who is brother to former President John Mahama, was being sought for allegedly accepting a bribe from Airbus to influence public officers to fast-track the deal.

Addressing the press in Accra today, Thursday, August 8, the Special Prosecutor, Kissi Agyebeng said the decision was taken after no evidence of bribery or corruption was established against Adam Mahama, his brother, former President John Mahama and other business associates.

"The Special Prosecutor has also directed authorised officers of the OSP to rescind the 13 May 2020 warrants of arrest obtained from the Circuit Court, Accra for the arrest of Samuel Adam Foster (also known as Samuel Adam Mahama), Philip Sean Middlemiss, Leanne Sarah Davis, and Sarah Furneaux.

"On 8 August 2024, the Special Prosecutor notified INTERPOL of the withdrawal of the Red Notice in respect of Samuel Adam Foster (also known as Samuel Adam Mahama), Philip Sean Middlemiss, Leanne Sarah Davis, and Sarah Furneaux," Mr Agyebeng said.

Again, Mr Agyebeng announced the decision by his office to close investigations into the alleged bribery of high-ranking Ghanaian officials by Airbus SE, through intermediaries, in respect of the sale of military transport aircraft by Airbus SE to the Republic of Ghana between 2009 and 2015. 

According to him, the office will also not "institute criminal proceedings against any person in respect of this investigation".
