Dear Sir/Madam, REJOINDER: WATERVILLE DISOWNS ALFRED WOYOME/WATERVILLE HOLDINGS DISSOCIATES ITSELF FROM ALFRED WOYOME Our attention has been drawn to a publication on your platform, myjoyonline.com & citifmonline.com that sought to paint a picture that, we believe, is not correct. In the said publication, you reported as follows: “M-Powapack, a firm represented by Mr. Alfred Woyome, was hired for a fee by Waterville to provide financial advisory and consulting services for a limited period to assist in Waterville financing the stadia contract. Waterville made full payment to M-Powapack and Mr. Woyome for their services”. We believe that it is important that this reference to the Waterville statement be placed in its proper context. The facts relating to Mr. Alfred Woyome’s relationship with Waterville are as follows: 1. To set the records straight, Waterville was recommended and referred to Alfred Woyome by BIC [Building Industry Consultants], who were supervisory Consultants to the CAN 2008 Stadia and related projects. It is true that Waterville engaged the services of M-Powapack and Alfred Woyome to provide the financial advisory and consulting services referred to in your report. These services were two-fold, a picture which does not come out clearly in your report. 2. In the first instance, for Waterville to win the bid for the construction and refurbishment of the stadia for CAN 2008, coupled with the construction of additional facilities [including a Cobalt 60 plant], a major pre-condition set by the Government of Ghana was that the bid should reflect the availability of secured funding. This pre-condition was met by the singular work done by Alfred Woyome! Without this condition being met, Waterville would not have won the bid. It is professional fees [together with attendant costs] that Mr. Woyome placed his claim on Government and secured his compensation through protracted discussions with Government officials and ultimately a Court settlement. 3. In the second instance, Waterville engaged Mr. Alfred Woyome to secure funding for the rehabilitation of the Accra, Kumasi and El Wak stadia, a contract awarded to Waterville after the initial project that, they [Waterville] had been asked to commence by the Government of Ghana pending signing of contract, had been unilaterally terminated by the Government of Ghana. Mr. Woyome duly procured the funding for Waterville and was paid for this particular assignment. When the initial process under which Waterville was granted concurrent approval by the Central Tender Review Board [CTRB], approval which obligated the Government of Ghana to consummate all attendant contracts relating to this process under Section 65[4] of the Procurement Act of the Republic of Ghana, was truncated by the Government of Ghana, Waterville was re-awarded the Accra, Kumasi and El Wak stadia projects leaving Mr. Alfred Woyome’s professional work [in obtaining the secured funding, as advertised in the international bid placed by the Government of Ghana, and as ASCERTAINED BY THE FINANCE COMMITTEE SET UP UNDER THE SAME ACT AND HEADED BY MR. VAN LARE DOSOO, FORMER DEPUTY GOVERNOR OF THE BANK OF GHANA] UNRECOGNIZED AND NOT CATERED FOR. It was on the basis of Mr. Alfred Woyome’s procuring the secured funding [with all its conditionality] that Waterville was given the indicated concurrent approval. Obviously, securing this funding facility placed an obligation on the Government of Ghana to pay the attendant fees and costs incurred in securing the funding. Waterville, in 2010, affirmed Mr. Woyome’s rights to claim in a letter to the Attorney-General and Minister for Justice, which letter was also copied to Mr. Woyome. It is these professional fees and costs that Mr. Woyome claimed from the Government of Ghana. The Judgment Debt awarded was the outcome of negotiations between the Government of Ghana and Mr. Alfred Woyome. As a matter of fact, Mr. Alfred Woyome was never a part of Waterville [BVI] and also not party to any of their contracts with the Government of Ghana in relation to the Accra, Kumasi and El Wak Stadia. Mr. Woyome could, therefore, never have been “dumped” or “disowned” by Waterville as some media reports [including that reported on your platform] have sought to portray. It is important that this distinction and clarity is presented to the good people of Ghana since it is our observation that the public has been ill-informed about the true facts surrounding this matter. We respectfully request that you PUBLISH THIS REJOINDER IN FULL AND that you would give this Statement the same level of prominence that you gave to the original one reporting on the Waterville Statement and thank you for your time and kind attention.
