Mr. Tony Lithur, lawyer for incarcerated MP for Keta Dan Abodakpi has followed up his verbal charges of bias against an Appeal Court judge with a formal letter to the Chief Justice.
Tony Lithur stunned the Appeal Court last week when he alleged he had evidence to prove that Justice Henrietta Abban, one of three judges hearing his client’s appeal, influenced the decision of the trial judge, Justice S.T. Farkye against his client, Dan Abodakpi.
The Keta MP is serving a ten-year-jail term for willfully causing financial loss to the state.
Tony Lithur insisted that Justice Henrietta Abban should step down from the panel or face a mini-trial to clear herself.
She has denied the allegations and says she is willing to withdraw from the three-member panel hearing the case. Again she is ready to face a mini-trial to prove her innocence.
In his letter to the Chief Justice sighted by Joy News, Tony Lithur repeats the allegations he made against Justice Henrietta Abban whom he said masterminded the maximum sentence of a 10-year jail term for his client.
The lawyer requests in his letter to the Chief Justice that the panel currently sitting on the case be rested, and asks that should the accused judge choose the mini-trial procedure, Mr. Abodakpi’s pending application for bail should go before a single justice of the court of appeal authorized to sit during the vacation under Article 138 of the constitution, since the mini-trial is likely to take some time.
The lawyer says his request for expeditious action in all cases stems from the fact the liberty of the individual is at stake and a judgment totally lacking in legal merit cannot be a just basis for continued incarceration of the applicant.
