An Accra Fast Track High Court has thrown out a stay of execution application by Adamu Daramani, the derobed MP for Bawku Central.
Lawyers for Mr Daramani filed the stay on the 24th of July against a ruling of the High Court which declared him unqualified to hold himself out as the Bawku Central MP.
Justice Abodapki dismissed the request Thursday morning, on the ground it was similar to an earlier stay which was rejected by the court.
Joy News reporter in court, Steven Anti says Mr. Daramani’s lead lawyer Yoni Kulendi has indicated his team would appeal the judge’s decision because the earlier application was different from the instant one.
Mr. Daramani’s lawyers argued that on July 24 they appealed against the High Court ruling and later the same day filed for a stay of execution pending their appeal.
The legal back-and-forth is the offshoot of a suit a cattle farmer Abdulai Biebel, in the constituency brought against Mr Dramani at an Accra High Court.
Lawyers of Mr Biebel argued Mr Daramani held a dual nationality and that it is unlawful for him (Daramani) to have contested as MP.
The court ruled in favour of Mr Biebel, declaring Mr Daramani unqualified to hold himself as an MP, following a failure on his part to file his defence.
Mr. Kulendi said if given the opportunity, his client would prove to his accusers that the people of Bawku Central knew their own and therefore voted for Dramani, being a son of the land.
He said all his client was seeking, was an opportunity to assess the merits of his case.
