The Land Division of the High Court in Accra has granted an interim injunction in favour of Labadi Beach Hotel, restraining Spartan Ives Limited, operators of Polo Beach Club, from encroaching on its property.
The injunction, issued on December 19, 2024, follows legal action initiated by Hotel Investments (Ghana) Limited, the hotel’s owners, to reclaim disputed land.
The court’s directive explicitly prohibits Spartan Ives Limited and its affiliates from:
1. Trespassing on 0.54 acres of the hotel’s property, including its use as a car park, pathway, or venue for events.
2. Operating the Polo Beach Club or hosting events on the hotel’s land or adjoining restricted areas.
3. Using the beachfront adjacent to the hotel’s property, in violation of the lease agreement dated November 27, 1990.
The injunction, effective for 10 days, warns of contempt proceedings against the defendants should they fail to comply.
This legal action reflects Labadi Beach Hotel’s determination to safeguard its assets amidst claims of land encroachment. The hotel’s management, led by David Eduaful, submitted supporting affidavits to assert its rights and protect its reputation as Ghana’s leading 5-star beach resort.
The court order represents a significant step in the hotel’s broader effort to resolve land disputes and maintain a tranquil environment for its guests. Further developments are expected as the case proceeds.
