The suspended Assin Central Secretary of the National Democratic Congress (NDC) in the Central Region, Sadique Broni Yeboah, has threatened legal action against the party unless his suspension is rescinded within three days.
In a letter addressed to the party's General Secretary, Mr Yeboah's lawyer demanded the party withdraw the suspension and provide Yeboah with a fair hearing.
The lawyer emphasised that the party's decision to suspend Yeboah without granting him the opportunity to present his case violates the principle of natural justice.
According to the statement, "this is a clear contravention of due process envisaged under Articles 48 and 49 of the party's Constitution and same infringes on the principles of natural justice to wit: audi alteram partem (hear both sides). To this extent, your decision is a complete nullity and void ab initio."
On the back of this and other premises, the NDC member has given the party three days to rescind the decision or face legal action.
"We have the instructions of our client to demand from you the withdrawal of his suspension forthwith within 3 days and give him a fair hearing if you find it meet so to do."
"Be informed that we have received strict and unqualified instructions from our client to take legal action against you in the event that you default in that regard," the letter added.
The suspension came after a high-stakes meeting with the party’s national executives, the Functional Executive Committee (FEC), and Assin Central executives.
The meeting focused on the withdrawal of Nurein Shiabu Migyimah from his position as the party’s Assin Central parliamentary candidate (PC) due to allegations of immoral behaviour and anti-party activities.
Mr Mijimah’s suspension followed an investigation by the NDC’s Central Regional Functional Executive Committee into complaints against him, including accusations of impregnating the wife of the party’s Assin Central General Secretary.
