Former Power Minister Dr Kwabena Donkor has criticised the appointment of Joseph Dindiok Kpemka as Deputy Managing Director of Bulk Oil Storage and Transportation Limited Company (BOST).
The Pru East MP said the former Deputy Attorney-General's appointment is unconstitutional.
He stated that President Nana Addo Dankwa Akufo-Addo lacks the constitutional authority to make appointments to any limited liability company.
According to Dr Donkor, BOST operates as a limited liability company, and therefore, the President does not have the power to appoint CEOs, Deputy MDs, or senior officers within the organisation.
Speaking in an interview with Citi FM on Sunday, May 19, he urged the President to adhere to the law in his appointments and refrain from unconstitutional actions.
“BOST is a limited liability company and there is a procedure for appointing officers and because it is a limited liability company, appointments must be governed by the Companies Act (992). The Presidency has no business in appointing CEOs or Deputy MDs or senior officers to any limited liability company.
“There is also the SIGA Act which also does not give the Presidency any appointing powers for limited liability companies."
“There is a procedure and as a people and as a nation, we must learn to respect the law, particularly coming from the Presidency. I have a lot of respect for the President but the Presidency is getting it totally wrong.”
President Akufo-Addo has appointed Joseph Kpemka, the former Deputy Attorney-General and Minister for Justice, as the Deputy Managing Director of the Bulk Oil Storage and Transportation Company (BOST).
A letter signed by the Secretary to the President, Nana Bediatuo Asante, instructed Energy Minister Dr. Matthew Opoku Prempeh to take the necessary steps to formalize Kpemka's appointment.
The appointment has stirred discussions regarding its constitutionality, given BOST's status as a limited liability company.
Dr. Kwabena Donkor, a former Power Minister, has voiced concerns about the legality of the President's direct appointment to a limited liability company like BOST.
