A High Court in Accra has nullified a report by the Office of Special Prosecutor (OSP) that implicated two individuals in the Labianca case.

The OSP's report had accused Col Kwadwo Damoah, a former Commissioner of the Customs Division at the Ghana Revenue Authority (GRA), and Joseph Adu Kyei, a former Deputy Commissioner of the Division, of misconduct in the case.

The court has also imposed costs of GHs10,000 against the OSP.

According to the report, the two officials allegedly utilised their positions to provide favorable tax treatment to Labianca Company, a frozen foods company owned by Council of State member Eunice Jacqueline Buah Asomah-Hinneh.

Damoah and Kyei filed a lawsuit against the OSP in November 2022, contending that the report lacked merit and had harmed their reputations.

In its judgment, the High Court sided with the plaintiffs, stating that the OSP had overstepped its authority in making adverse findings. Additionally, the court issued an order of prohibition, restraining the OSP from further investigating Damoah and Kyei in connection with the Labianca case.
