Member of Parliament for Wa West, Peter Lanchene Toobu, has said that there is no guarantee that embattled Madina MP, Francis-Xavier Sosu, will make an appearance in court on November 8.
The lawmaker is expected to respond to charges filed against him by the Police.
These charges include; causing damage to public property during a protest he led in his constituency on October 25.
The police filed the suit after the MP refused to honour an invitation to be questioned over some unlawful actions that characterized the October 25 demonstration.
Speaking to JoyNews, on Wednesday, Peter Toobu, who is also a retired Police officer, described the move by the law enforcement agency as one that will be unsuccessful.
He said that the law demands that the Police serve the suit to Francis-Xavier Sosu through the Speaker of Parliament.
“They have the duty to prove beyond reasonable doubt that the Member of Parliament is guilty of the charge. But that notwithstanding, they have to serve him with the court processes. They will have to go through the procedure and serve it on the honourable member though the Speaker,” he said.
Peter Toobu also called on the Police and Parliament to collaborate for national development.
“This whole show is an exercise in futility. The Police and Parliament must begin to work together for national development. It is not for competition. They must complement each other's efforts to build the country,” he added.
Meanwhile, the Speaker of Parliament has fumed over attempts by the Police to disregard his earlier directive and and prefer charges against the Madina MP, even before the Privileges Committee begins hearings on the contempt case against the two senior officers.
The Speaker said the action of the Police is not only a violation of the 1992 Constitution but disingenuous as well.
In a statement issued on Wednesday, he also observed that the attempt to arrest Mr. Sosu during a church service last Sunday is an affront to Parliament and his powers.
