Today, The Law discussed Citizenship vs Allegiance: Complications of dual citizenship.
Host, Samson Lardy Anyenini and his panelists, D&D fellow in public law and justice, CDD-Ghana, Prof. Kwaku Asare and Dr Justice Srem Sai, a lecturer at GIMPA Law school, examinined the country's laws and what they say about dual citizenship.
This comes at a time when Mr Gyakye Quayson's election as the Member of Parliament for Assin North has been nullified by a High Court. This followed a suit by a resident of the constituency, Michael Ankomah Nimfah at the Cape Coast High Court, challenging Mr Quayson's qualification to contest the 2020 Parliamentary elections because he held Ghanaian and Canadian citizenship, at the time of filing his candidature.
According to Citizenship Act, 2000 (Act 591), "A citizen of Ghana may hold the citizenship of any other country in addition to his citizenship of Ghana."
However, "Without prejudice to Article 94(2)(a) of the Constitution, no citizen of Ghana shall qualify to be appointed as a holder of any office specified in this subsection if he holds the citizenship of any other country in addition to his citizenship of Ghana:
a. Chief Justice and Justices of the Supreme Court….
m. Any other public office that the Minister may by legislative instrument prescribe."
