The Minority in Parliament has registered its disappointment with the ruling of the Cape Coast High Court, which annulled the 2020 Parliamentary Elections in the Assin North constituency.
On Wednesday, July 28, the Court presided over by Justice Kwasi Boakye, ordered for fresh elections to be conducted in the constituency.
The petitioner, Michael Ankomah Nimfah, stated that the MP, James Gyakye Quayson at the time of filing to contest the 2020 parliamentary elections, had not renounced his Canadian citizenship and thus held dual nationality.
He further avers that at the close of nominations on the 9th of October, the Assin MP had not still renounced his Canadian nationality.
Handing his judgement Justice Boakye mentioned that Mr Quayson, who still holds himself as the MP, is in complete violation of Article 94 (2a), declaring his election null and void.
But speaking to JoyNews' Joseph Opoku Gakpo, the Member of Parliament (MP) for South Dayi Rockson Dafiamekpor said they will appeal the decision and seek a stay of execution from the court.
"As a member of the NDC we are a bit disappointed with the ruling but that is the ruling of the court and as a practising lawyer I know the remedial steps available. I know that as a party, we will appeal the ruling, and when that happens then the remedy available will be to apply for stay pending the determination of the appeal.
"It is extremely costly to run a by-election when the law of the matter as it is, is not properly settled, settled as in the highest level, we are prepared to take this all the way to the Supreme Court,"
He further urged party members to remain calm as processes unfold to challenge the ruling.
"For now, we want to urge all party members and every concerned Ghanaians to remain calm whiles we consider all the legal remedies available."
The current development will whittle the numbers of MPs of the National Democratic Congress (NDC) by one.
This will leave NDC with 136 MPs whiles the NPP will still have a 137 MPs.
