The Ako Toboase family is in court seeking to restrain the Ayawaso West Wuogon Municipal Assembly and its Chief Executive, Sandra Owusu-Ahinkorah from interfering in anyway with the ownership of lands the family claims to own.
These include lands located at Shiashie, Abotsiman and other places within the Ayawaso West Wuogon Constituency.
One Awudu Musa who is said to be the head of the task force at the assembly is also named as a defendant.
A representative of the family, Nii Sowah Ako-Odoi insists the assembly has erected several sign posts claiming portions of the land and have in some instances fenced same without their concern.
He also alleges that some of the lands belonging to the family have been sold by the assembly.
He is, therefore, asking the High Court to stop the MCE or representatives of the assembly from carrying out any such act.
But the assembly disagrees and had attempted to have the case dismissed on technical grounds.
It had argued that the family should have notified the assembly of its intention to sue, one month prior, as required under the Local Governance Act.
The court however dismissed this argument.
It ruled that officials of the assembly rather refused to take delivery of a letter the family had written to communicate plans to sue.
JoyNews has since sighted a petition sent to the office of the Chief of Staff at the Presidency over the matter.
In the petition signed by one Dr. Sledge Duodu, he alleges that officials of the assembly have engaged in multiple sale of lands in the area.
Again, Dr. Duodu said he has paid a total of GHC790,000 for land a representative of the assembly claimed was selling to him.
He said he later found out that the same land had been sold to another developer who apparently paid a higher amount.
His petition was attached to documents the Ako Toboase family filed in court in support of the request that the MCE, Sandra Owusu-Ahinkorah and her agents be restrained from dealing with those lands.
