Private legal practitioner, Gary Nimako Marfo has hinted that the Assin North MP-elect, James Gyakye Quayson cannot be sworn-in in the 8th Parliament.
According to him, Mr Quayson owes allegiance to both Ghana and Canada which violates the provision of Article 94 (2) (a) of the 1992 Constitution of Ghana.
He indicated that at the time when the MP-elect filled his nomination with the Electoral Commission, he was still holding on to his Canadian citizenship.
This he said called for the disqualification of the candidate but the EC failed to do that and allowed him to go through the system which led to his victory in the December 7 elections.
“Mr Quayson has a Canadian passport and a Ghanaian passport. And we also realised that Mr Quayson got his certificate of renunciation on November 26, 2020.
“The fidelity of our Constitution must be upheld, our Constitution is very clear, and to the effects that if you want to contest in parliamentary elections.
"You ought not to hold dual citizenship. You must not owe any allegiance to any other country,” he explained.
His comment comes after the Cape Coast High court granted an injunction suit against, James Gyakye Quayson.
The court has ruled that James Gyakye Quayson cannot hold himself as the MP-elect for the constituency.
The petition was filed by one Michael Ankomah that the MP-elect still held on to his Canadian citizenship when he was filing to contest in the December polls.
The current development will whittle the numbers of MPs of the National Democratic Congress (NDC) by one.
This will leave NDC with 136 MPs whiles the NPP will still have a 137 MPs.
