The Alliance for Social Equity and Public Accountability (ASEPA) has petitioned the Chief Justice to recuse Supreme Court Judge, Justice Jones Dotse from all election-related hearings and adjudication.
According to ASEPA, "this has become necessary due to high rumours circulating among the corridors of power that the learned Supreme Court Judge is being considered for the position of Speaker of Parliament in the 8th Parliament...".
"Even though Justice Jones Dotse's name has not been publicly mentioned, it is thrive knowledge among a section of Ghanaians that he is being considered for the Speakership position, and even though they mere rumours, we believe it is enough to prejudice him and as such the calls for his refusal from all election-related cases" it stated.
In a press release signed by its Executive Director, Mensah Thompson, the Civil Society Organisation (CSO) believes that this puts Justice Dotse in a "prejudicial position" which may compromise his objectivity as a judge in the matter.
“Considering the fact that the learned Judge seems to be a nominee of the ruling party, we believe that puts the judge in a prejudicial position incapable of making an independent determination of any election-related proceedings,” it reads.
The document further urged Chief Justice Kwasi Anin-Yeboah to strategically select judges to arbitrate the National Democratic Congress' (NDC) legal challenge of the election 2020 results.
"Kindly consider this petition urgently before empanelling judges to sit on any election-related case so as to protect the image, integrity, and independence of the Judiciary especially in adjudicating the pending election petition brought by the NDC".
