A Tamale High Court has adjourned the trial of three soldiers charged with the murder of Alhaji Issah Mobila, once chairman of the Northern Region branch of the Convention People’s Party.
The court adjourned hearing to enable the new defense counsel to study the writ filed against the three men.
The adjournment will also enable the Chief of Defense Staff to study the details of the suite.
Alhaji Mobila, who was once chairman of the CPP in the Northern Region was killed shortly after the 2004 elections while in military custody.
That was after he had allegedly presented himself to the police after he had been informed that he was being sought by them.
Alhaji Mobila’s arrest was in connection with claims that he had been in possession of weapons.
The police conducted searches in his car and residence but found no weapons.
He was alleged to have subsequently been transferred from the Central Police Station to the Military Barracks at Kamina where he was allegedly tortured to death by the suspects.
An autopsy report on the deceased by a pathologist from the Komfo Anokye Teaching Hospital in Kumasi indicated that he had died from multiple internal injuries as a result of torture although the police had earlier claimed that Alhaji Mobila had died from an illness.
Investigations into the matter implicated the three men who were subsequently charge with engaging in circumstance that led to the death of the former CPP chairman.
In court on Tuesday, the defense counsel led by Lawyer Tibias Sory prayed the court to grant his team ample time to study the fine details of the writ and earlier proceedings on the case.
The court presided over by Justice Lawrence Mensah granted the defense their request and subsequently adjourned hearing to June 3, 4 and 5, 2009.
