Kotoko boss to contest ban

The lawyers for the embattled Asante Kotoko boss, Sylvester Asare-Owusu, claim he will defy an imposed five-year ban for his role in the Baba Yara Stadium overcrowding incident which resulted in the death of four fans. They are asking for a copy of the relevant appointing Instrument and terms of reference of the committee and want to ascertain if it was established under Chapter 23 of the constitution. If it is just a normal administrative committee then the Asante Kotoko boss is not obliged to report to them. "We must humbly remind you that the Ministry of Sports has absolutely no control over association football in Ghana," a statement read. "Your alleged ban is not only unconstitutional but an attempt to interfere with the running of undertakings to Fifa betweeen 2005-2006, which led to the Ghana Football Association adopting new statutes that removed all government control over association football in Ghana." They are therefore contesting his removal from office which took immediate effect when the pronouncements were made on Monday. "Kindly note that Asante Kotoko is a private limited liability company duly incorporated under the laws of Ghana," the letter to the Minister read. "Respectfully, you have no power to remove any person from any position within the club, determine who serves in any position in the club or limit the activities that are required of a director of a club." Sylvester Asare-Owusu was indicted for his role in collecting monies from fans who scaled over the stadium walls to watch the said match between Kotoko and Hearts on 8 February.
